This is not simply a website, nor is it a conventional marketplace. It is an extension of a cultural house—one grounded in legacy, authorship, and the belief that art is not merely acquired, but entered into.By accessing this website, engaging with the Gallery, or acquiring a work—whether online, through private appointment, within a salon setting, or through direct communication—you are agreeing to the terms that guide this environment.
These Terms of Use exist not only to define boundaries, but to preserve the integrity of the experience—for the artist, for the work, and for every collector who becomes part of its ongoing story. If these terms do not align with your expectations, we ask that you refrain from using the site or engaging in transactions with the Gallery.
A Different Kind of Gallery
The Distelheim Gallery operates as a single-artist, narrative-driven cultural house.
What this means, in practice, is that engagement here is not transactional. It is guided. It is contextual. It is intentional.
Collectors are invited into a process that may include conversation, onboarding, private presentations, and, in many cases, direct dialogue with the artist himself. The goal is not simply to present work—but to create alignment between the work and the life it will enter.
Every interaction, whether brief or ongoing, exists within this framework—and is governed by these Terms.
Who This Is For
By choosing to engage with the Gallery, you are confirming that you are able to enter into a binding agreement, that you are at least eighteen years of age, and that the information you provide is accurate and complete.
The Work—and What Protects It
Everything you encounter here—every image, every piece of writing, every work of art—is protected.
The artwork, the language, the presentation, the visual identity, and the narratives themselves are the intellectual property of The Distelheim Gallery and the artist. They are safeguarded under U.S. and international law.
As such, they may not be reproduced, copied, distributed, altered, commercialized, tokenized, or used to train artificial intelligence systems without explicit written permission.
This includes the creation of derivative works, the use of images in commercial contexts, or the conversion of artwork into digital assets such as NFTs.
What is permitted is simple: you may view, experience, and share the work in a personal, non-commercial context, provided that proper attribution is maintained.
On Representation and Presence
We take great care in how each work is presented.
Descriptions, dimensions, materials, and edition details are provided with the intention of clarity. And yet, there is an understanding that must be held:
No digital representation can fully capture the physical presence of a work.
Color may shift. Texture may reveal itself differently. Scale may feel altered on a screen. Each work remains, fundamentally, a physical object—unique, dimensional, and experienced most fully in person.
On Acquisition
All acquisitions through The Distelheim Gallery are considered final.
This is not a limitation—it is a reflection of the process itself.
Collectors are given the opportunity to ask questions, request additional materials, engage in conversation, and arrive at a decision with clarity and confidence. Because of this, purchases are not structured for return, exchange, or cancellation.
The Gallery reserves the right, at its discretion, to decline or cancel any transaction, limit availability, or determine placement of works in alignment with its broader curatorial and stewardship goals.
Pricing and Payment
All works are priced in U.S. dollars unless otherwise noted, and pricing may evolve over time.
Payment must be completed in full prior to release or shipment of any work. This may be done through standard methods such as credit card or wire transfer, or through privately arranged terms approved by the Gallery.
Incomplete payment may result in cancellation of the acquisition.
Shipping and Transfer of Responsibility
Shipping is handled in accordance with the Gallery’s Shipping Policy.
Once a work has been transferred to a carrier and delivery is confirmed, responsibility passes to the collector. While every effort is made to ensure safe and timely delivery, the Gallery cannot be held responsible for delays or disruptions caused by carriers, customs processes, or events beyond its control.
The Salon and the Circle
Much of what defines The Distelheim Gallery happens within smaller, more intimate environments—private showings, salon gatherings, and invitation-based experiences.
Participation in these settings is both a privilege and a responsibility.
Guests are expected to engage with respect—for the work, for the artist, and for one another. Privacy is essential. The identities, conversations, and perspectives of other collectors are not to be shared.
The Gallery retains full discretion over invitations and participation, and reserves the right to revoke access where necessary.
Use of the Site
The website exists as an extension of the Gallery’s physical and conceptual space.
It is not to be used for unlawful purposes, nor for attempts to access restricted systems, disrupt functionality, or misrepresent identity or intent. Respect for the platform reflects respect for the work itself.
Third-Party Elements
Certain aspects of the site may rely on third-party services—payment processors, hosting providers, or embedded content. While these are selected carefully, the Gallery is not responsible for their independent practices or policies.
What We Can—and Cannot Promise
This website and its contents are provided as they are.
We do not guarantee uninterrupted access, absolute accuracy, or the absence of technical errors. Nor do we offer warranties—express or implied—regarding the suitability of the site or its contents for any particular purpose.
Limits of Responsibility
To the fullest extent permitted by law, The Distelheim Gallery is not liable for indirect or consequential damages, loss of opportunity, or issues arising from use of the site or services.Should liability arise, it is limited to the amount paid for the specific work in question.
Shared Responsibility
By engaging with the Gallery, you agree to take responsibility for your actions within it.
You agree to hold the Gallery harmless from claims arising from misuse of the site, violation of these Terms, or infringement of any rights.
Privacy and Change
Your engagement is also governed by the Gallery’s Privacy Policy, which outlines how information is handled and protected. These Terms may evolve over time. Continued use of the site constitutes acceptance of any updates.
Legal Framework
These Terms are governed by the laws of the State of Illinois.In the event of a dispute, resolution will begin with good-faith conversation. If necessary, it will proceed to binding arbitration within Illinois. By engaging with the Gallery, you waive the right to jury trial or class action.
Beyond Our Control
There are moments—unpredictable, unavoidable—where circumstances intervene.
Events such as natural disasters, illness, supply chain disruptions, or governmental actions may impact timing or delivery. In such cases, the Gallery is not held liable for delay or disruption.
The Full Agreement
These Terms, together with the Gallery’s Privacy and Sales policies, represent the complete understanding between you and The Distelheim Gallery.
On Stewardship Beyond Acquisition
To acquire a work from The Distelheim Gallery is to enter into something ongoing.
Should a collector ever choose to resell a work, the Gallery asks to be part of that conversation—to assist in placement, to maintain continuity, and to protect the integrity of the work’s history.
Ownership may be recorded within a confidential registry, not as surveillance, but as stewardship—ensuring that provenance, authenticity, and legacy remain intact over time.
For works issued in limited editions, scarcity is not incidental—it is protected. Editions are fixed. In some cases, unsold works may be retired or destroyed to preserve that integrity.
Respect for the Work
Every work carries with it the artist’s authorship and intent.
It is not to be altered, distorted, or presented in a way that compromises its meaning or attribution. The integrity of the work extends beyond its physical form—it includes how it is seen, shared, and remembered.
Documentation and Presence
The Gallery may document its work and its environments—through photography, video, and publication.
This includes installations, salon gatherings, and the works themselves. Such documentation may be used for editorial, archival, or promotional purposes, always with care, and without disclosing personal information without consent.
Participation in salon environments, whether in person or virtual, carries an understanding that these spaces are shared, and that documentation may occur.
At the same time, discretion is expected. Private conversations, identities, and unpublished materials are to remain within the room.
