The Distelheim Gallery, LLC

The Distelheim Gallery, LLC operates as a steward of original artistic authorship and its associated intellectual property. Every work presented—whether physical, digital, or conceptual—is protected to the fullest extent permitted under United States copyright law, international treaties, and applicable common law rights.

All artwork created by Jefferey Cornett, including but not limited to original works, limited editions, studies, digital compositions, mixed media works, and all derivative or preparatory materials, constitutes protected intellectual property. This protection extends to the visual image, composition, underlying concepts, and all reproductions thereof, regardless of format or medium.

Copyright is not transferred through sale.

The acquisition of a physical work does not convey any rights of reproduction, distribution, display beyond private use, licensing, modification, tokenization, or commercial exploitation. All such rights remain exclusively with the artist and/or The Distelheim Gallery unless expressly granted through a written, executed licensing agreement.

Any unauthorized use of artwork or related materials is strictly prohibited.

This includes, without limitation:

  • Reproduction in any format (print, digital, photographic, or otherwise)

  • Use in advertising, branding, marketing, or promotional materials

  • Inclusion in publications, media, or editorial content without authorization

  • Creation of derivative works, adaptations, or reinterpretations

  • Digital tokenization, NFT minting, or blockchain-based usage

  • Commercial display or public exhibition not coordinated with the Gallery

  • Resale accompanied by unauthorized image use or marketing materials

Artificial Intelligence, Machine Learning, and Dataset Prohibition

The use of any artwork, image, text, or content originating from The Distelheim Gallery for the purpose of training, developing, fine-tuning, or improving artificial intelligence systems, machine learning models, or generative technologies is expressly prohibited.

This prohibition includes, but is not limited to:

  • Scraping, crawling, or harvesting images or text for dataset creation

  • Inclusion in training datasets for generative AI models

  • Use in diffusion models, image generators, or style-transfer systems

  • Embedding in vector databases or multimodal training pipelines

  • Any form of ingestion designed to replicate, simulate, or derive from the artist’s work

No third party, platform, or developer is granted any implied license for such use. Any such activity without prior written consent constitutes willful infringement.

The Distelheim Gallery actively monitors for infringement across digital, print, and emerging platforms, including marketplaces, social media, auction channels, and AI systems.

Enforcement is immediate and uncompromising.

Any unauthorized use may result in:

  • Immediate cease-and-desist demands

  • DMCA takedown actions across platforms and hosting providers

  • Claims for statutory and actual damages under applicable law

  • Recovery of profits derived from unauthorized use

  • Injunctive relief to prevent further misuse

  • Recovery of legal fees and enforcement costs

Where willful infringement is identified—including unauthorized AI or dataset use—the Gallery will pursue the maximum remedies available.

Collectors, institutions, and partners are expected to respect these rights as part of their engagement with the Gallery. Any ambiguity regarding usage should be resolved in advance through direct written permission.

Limited licensing opportunities may be granted at the sole discretion of the Gallery. All such agreements will clearly define scope, duration, media, territory, and compensation.

The purpose of this policy is not merely legal—it is protective.
It ensures that the work, its meaning, and its authorship remain intact, controlled, and uncompromised across time, across platforms, and across technologies.
